Terms of Service and Disclaimer

These Terms of Service govern the rights, obligations, and responsibilities between the individual operator (hereinafter "Operator") and users (hereinafter "Users") in connection with the use of the FactBOGI service (hereinafter "Service") operated by the Operator.

Article 1 (Purpose of the Service)

This Service aims to provide reference materials for information judgment by allowing Users to share their opinions on internet articles, posts, SNS content, and other media, and to present various evidence and perspectives regarding the factual accuracy of information.

This Service does not replace news agencies, government bodies, judicial institutions, or accredited fact-checking organizations. Users bear sole responsibility for their final judgments regarding information and any consequences thereof.

Article 2 (Definitions)

  1. "Service" means the FactBOGI website and all associated features.
  2. "User" means any person who agrees to these Terms and uses the Service.
  3. "Member" means a User who has registered via email and holds a username and password.
  4. "Opinion" means content (text, assessments, links, etc.) submitted by a User together with a source URL.
  5. "Source URL" means an external webpage address submitted as evidence when posting an Opinion.
  6. "Comment" means a text response written by a User in reply to an Opinion.
  7. "Like/Dislike" means a User's act of expressing approval or disapproval of an Opinion.
  8. "Opinion Code" means an automatically issued identifier in the format FB-XXXXX used to identify and share Opinions.
  9. "Blind Processing" means the state in which an Opinion has been made private due to accumulated reports or at the author's request.

Article 3 (Validity and Modification of Terms)

  1. These Terms take effect upon posting on the Service interface.
  2. The Operator may modify these Terms within the limits permitted by applicable law and will provide prior notice of any changes.
  3. If a User does not agree to the modified Terms, the User may discontinue use of the Service.

Article 4 (Service Content)

  1. Creation and publication of Opinions based on source URLs
  2. Like (approval) / Dislike (disapproval) evaluations of Opinions
  3. Writing Comments and replies on Opinions
  4. Members-only Poll voting on Opinions (Agree / Disagree / Abstain β€” 3 choices, available for 7 days after posting)
  5. Tree-linking structure connecting Opinions as agree or doubt
  6. Issuance of Opinion Codes (FB-XXXXX) and embed widgets for Opinion sharing
  7. Keyword-based Opinion search
  8. Display of advertising content (including advertisements for operational revenue)

The Operator may modify or discontinue part or all of the Service as required for operational or technical reasons.

Article 5 (User Obligations)

  1. Users must not defame others by asserting false facts as definitive truths.
  2. Users must not slander or insult specific individuals, organizations, or companies.
  3. Users must not post profanity, hate speech, obscene material, or illegal information.
  4. Users must not infringe upon the rights of others, including copyrights, portrait rights, or personal information.
  5. Users must not use automated tools to engage in abnormal use of the Service.
  6. Users must not register source URLs that are unrelated to or unsupportive of the Opinion's stated evidence.
  7. Users must not engage in repeated or organized liking or disliking of the same Opinion.
  8. Users must not manipulate votes or reports using automated tools.

Users bear full legal responsibility for the content of Opinions they post.

Article 6 (Responsibility and Management of Opinions)

  1. Responsibility for all Opinions posted on the Service lies with the User who posted them.
  2. The Operator does not guarantee the accuracy, truthfulness, or reliability of Opinions.
  3. The Operator may delete or restrict Opinions without prior notice in the following cases:
    • Opinions that violate or are suspected of violating applicable laws
    • Opinions suspected of constituting defamation or spreading false information
    • Opinions containing profanity, hate speech, obscene material, or illegal information
    • Opinions that grossly contradict the purpose of the Service
  4. If an Opinion receives reports from multiple Users, it will be automatically blinded upon accumulation of 5 or more reports, after which the Operator will review it.
  5. The author may permanently blind their own Opinion by entering the Opinion Code. Permanently blinded Opinions cannot be restored.
  6. The original data of blinded Opinions will be encrypted using AES-256-GCM, retained for a specified period, and then destroyed. The specific retention period follows the Privacy Policy.

Article 7 (Disclaimer for Opinions and Information)

  1. Opinions posted on this Service represent the personal views of their authors and do not reflect the official position of the Operator.
  2. The Operator does not guarantee that information contained in Opinions is factual.
  3. Users should use the Service only as reference material, and the Operator shall not be liable for damages arising from reliance on such information.
  4. Responsibility for copyright infringement in content included in source URLs submitted by Users lies with the User who registered those source URLs; the Operator shall bear no liability therefor.
  5. The Operator shall bear no liability for damages caused by unauthorized collection, processing, or redistribution of Opinion content displayed on external sites via embed widgets.

Article 8 (Disclaimer for External Links)

  1. External links included in the Service are provided for the convenience of Users.
  2. The Operator shall not be liable for the content, accuracy, or legality of external sites.
  3. Responsibility for all issues arising from the use of external links lies with the User.

Article 9 (Service Interruption)

The Operator may temporarily suspend the provision of the Service in cases of force majeure such as server maintenance, system upkeep, natural disasters, or communication failures, and shall bear no liability therefor.

Article 10 (Copyright)

  1. Copyright in Opinions posted on the Service belongs to the User who authored them.
  2. Users grant the Operator a non-exclusive license to use their Opinions within the scope of Service operation, promotion, embed widget provision, and search indexing.
  3. Copyright in original content at source URLs registered by Users belongs to the respective external sites.
  4. Responsibility for copyright disputes arising from the registration of source URLs lies with the User who registered those source URLs.

Article 11 (Governing Law and Jurisdiction)

Disputes arising in connection with these Terms and the use of the Service shall be governed by the laws of the Republic of Korea, and the competent court shall be determined pursuant to the Civil Procedure Act of the Republic of Korea.

Article 12 (Advertising)

  1. The Service includes advertising for operational revenue.
  2. Advertisements within the Service may be placed through the Operator or third-party advertising platforms (Google AdSense, Kakao, Naver, etc.).
  3. Responsibility for the accuracy and legality of advertising content lies with the respective advertiser.
  4. Users may not hold the Operator liable for damages arising from the use of advertising content.
